Administered by Whatnot Inc. (“Administrator” or “Whatnot”)
NO ENTRY FEE. NO PURCHASE OR OBLIGATION NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.
The Command Zone Sweepstakes (the “Sweepstakes”) begins on March 27, 2024 at 10:00 AM ET and ends on March 27, 2024 at 7:00 PM ET (the “Sweepstakes Period”). Administrator’s clock will be the official timekeeper for the Sweepstakes.
1. Agreement to Official Rules. By entering or participating in the Sweepstakes, you accept and agree to be bound by these “Official Rules.”
2. Eligibility. This Sweepstakes is open to legal residents of the United States and the District of Columbia (excluding New York and Florida) who are 18 years of age or older at the time of entry, and have Internet access. The Sweepstakes is void outside of the United States and where prohibited or otherwise restricted by law or by these Official Rules. Employees of Sponsor and Administrator and their respective affiliates, subsidiaries, advertising, promotion and fulfillment agencies, or other parties in any way involved in the development or production of the Sweepstakes, and their respective agents, subsidiaries, affiliates, directors, officers, consultants, employees, contractors, and representatives, and each of their immediate family members (e.g. spouse, parent, child, sibling, grandparent, and spouse or “step” of each) and persons living in the same household of each, whether or not related, are not eligible to participate in the Sweepstakes.
3. How to Participate. You may enter the Sweepstakes in one of the following two ways:
a. Enter by viewing the Livestream on the Whatnot App: Current users and new users of Administrator’s free mobile application (the “Whatnot App”) may enter by completing the following steps:
i. If you are a new user of the Whatnot App and do not already have the Whatnot App installed, you will need to download and install the Whatnot App available at https://www.whatnot.com/ and create a Whatnot account to participate via this method of entry; and
ii. Tune into the livestream hosted by Command Zone on the Whatnot App (the “Livestream”) scheduled to start on March 27, 2024 at 4:00 PM ET and follow the posted instructions to enter the Sweepstakes. (To find Command Zone’s show, search ‘command’ > click the ‘users’ tab > click on the user ‘command’. You may follow and bookmark Command Zone’s show before the Livestream is scheduled to take place to be notified when the Livestream begins.)
iii. Make a purchase during the show and then sign up for the Buyer Appreciate Giveaway or follow the instructions posted to enter via the alternative method

To set up a Whatnot account, you must provide the required information as instructed within the Whatnot App. By downloading the Whatnot App and creating a Whatnot account, you agree to the Whatnot Terms of Service located at https://www.whatnot.com/terms and Privacy Policy located at https://www.whatnot.com/privacy. If you do not agree to such Terms of Service and Privacy Policy, you cannot create a respective account, and will be ineligible to receive the Prize. Eligible persons that complete steps (i) and (ii) above will each receive one (1) entry into the Sweepstakes.
Only one (1) entry per person, household and/or e-mail address is permitted, regardless of method of entry. Entrants submitting multiple entries or violating any of these Official Rules may be disqualified. Proof of submission of an entry does not constitute proof of delivery or receipt. No automatically generated entries will be accepted. No mechanically reproduced mail-in entries are allowed and any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods.
4. Drawing. All Sweepstakes entries meeting the requirements of these Official Rules will be entered into a drawing to be held during the Livestream. The drawing will be conducted by a computer program that randomly chooses a winner (the “Winner”) from all eligible entries received and the random selection is final and binding. Alternate potential winners may be selected through the same process as the Winner.. Such alternate potential winners may become the Winner (in the order in which they were drawn) in the event the Winner cannot be contacted, is ineligible, fails to claim the Prize, fails to complete any required affidavit of eligibility or publicity/liability release, and/or fails to comply with any of the Sweepstakes requirements.
5. Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR AND ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
6. Prizes and Odds. The Winner will receive the following (collectively, the “Prize”):
Roundtrip coach airfare, two (2) night’s stay in a hotel in Burbank, CA, invitation to play Magic: The Gathering with Command Zone on the series titled: Extra Turns (the “Event”), and reasonable ground transportation to and from the applicable airport, hotel, and the Event; approximate retail value (“ARV”): $2,000 (USD).
Total ARV of the Prize to be awarded: up to $2,000 (USD). ARV will vary based on Winner’s location. If the actual value of the Prize is less than the stated ARV, the difference will not be awarded.
The filming date, to be mutually agreed upon by both parties, will take place no more than 3 months from the end of the Sweepstakes Period.
The odds of winning the Prize depend on the total number of eligible entries received. No cash or other substitution of prizes is permitted, except at the sole option of Sponsor or Administrator for a prize of equal or greater value. Sponsor or Administrator will not replace a lost or stolen Prize. Winners are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to the Prize. You agree to provide Sponsor or Administrator with any additional information and complete any required tax or other forms relating to your receipt of the Prize. Allow three (3) to four (4) weeks for delivery of the cash prizes.
7. Additional Travel Terms. Without limiting any other terms of these Official Rules, Winner must execute an affidavit of eligibility and publicity/liability to receive the Prize.
All expenses and incidental travel costs not specifically stated in the Prize description above, including, but not limited to, transfers; meals; beverages; mini-bar; insurance; gratuities; souvenirs, etc. are the sole responsibility of Winner. Winner must possess necessary travel documents, e.g., federal or state issued ID, at least seven (7) days prior to travel. Winner may be required to provide proof of COVID-19 vaccination or a written attestation that Winner cannot be vaccinated because of a medical condition or sincerely held religious belief, prior to issuance of travel documents. Winner will be required to provide valid government issued picture ID at time of travel; any identification requirements associated with air travel or acceptance of the Prize is the responsibility of Winner. Failure to obtain required travel documents by Winner may result in forfeiture of the Prize.
Winner irrevocably waives all claims against the Indemnities and agree that the Indemnities will have no liability or responsibility and shall be held harmless by entrants for any claim arising in connection with: (a) a potentially heightened risk of exposure to communicable diseases, viruses, bacteria or illnesses (including, without limitation, COVID-19) and the causes thereof; (b) sickness arising as a result of Winner participating in the Sweepstakes and related activities, wherever, whenever or however the same may occur; and (c) any delay or costs associated with the foregoing, all of which will be borne at Winner’s sole expense. Winner must also pass any required medical testing and comply with any requirements, at any time, that may be required or recommended by any government agency, airline, Administrator or Sponsor, including without limitation, passing one or more COVID-19 antigen and screening tests, and testing negative for COVID-19. Failure to do so may result in forfeiture of the Prize.
Sponsor or Administrator will be responsible for arranging flight and hotel accommodations reservations, in connection with which Winner may be consulted, however, Sponsor and Administrator retain the right to exercise discretion (including, without limitation, choice of airline, hotel and travel dates) and its decisions will be final. Travel must originate from and end at the same airport. All travel and accommodations are subject to availability, change and restrictions. Once travel commences, no stopovers are permitted; if stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. No changes will be made to travel details once any portion of travel arrangements has been made. Ticket re-issues and/or time extensions are not allowed. Flight details are subject to the airline carrier’s regulations and conditions. No refund or compensation will be made in the event of the cancellation or delay of any flight. Winner’s travel may not qualify for frequent flyer miles. Winner is solely responsible for Winner’s own conduct while accepting the Prize and agrees to
comply with all applicable laws, rules, and regulations pertaining to use and enjoyment of the Prize (including without limitation any applicable health and safety policies and procedures).
8. Notification of Winners. The Winner will be announced during the Livestream and will be notified by email within one (1) business day of the Livestream, and must sign and return any required affidavit of eligibility and publicity/liability release. If the Winner cannot be contacted, is ineligible, fails to claim the Prize, fails to complete any required affidavit of eligibility or publicity/liability release within the days specified in the notification or thirty (30) days after such notification, whichever comes first, and/or fails to comply with any of the requirements, the Prize may be forfeited. Upon Prize forfeiture or inability to use a Prize or portion thereof, no compensation will be given, and Sponsor and Administrator will have no further obligation to that entrant. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email account specified in the entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
9. Disclaimers and Limitations on Liability.
a. Whatnot and Command Zone are not responsible for (i) late, lost, delayed, damaged, postage-due, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by email or postal mail or otherwise; (ii) theft, destruction, unauthorized access to or alterations of entry materials; or (iii) phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties.
b. IN NO EVENT WILL SPONSOR OR ADMINISTRATOR BE LIABLE TO YOU FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE SWEEPSTAKES, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SPONSOR OR ADMINISTRATOR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
10. Indemnification. You agree to release, indemnify, defend and hold Sponsor and Administrator and each of its parent, affiliates, subsidiaries, directors, officers, employees, sponsors and agents, including advertising and promotion agencies, and assigns, and any other organizations related to the Sweepstakes (collectively, the “Indemnities”), harmless, from any and all claims, injuries, damages, expenses or losses to person or property and/or liabilities of any nature that in any way arise from participation in this Sweepstakes or acceptance or use of the Prize or parts thereof, including, without limitation, (i) any condition caused by events beyond the control of Sponsor or Administrator that may cause the Sweepstakes to be disrupted or corrupted; (ii) the Prize, or acceptance, possession, or use of the Prize, or from participation in the Sweepstakes; and (iii) any printing or typographical errors in any materials associated with the Sweepstakes.
11. Publicity. Except where prohibited, by participating in the Sweepstakes, you consent to the use of your Whatnot username, name, photo and/or likeness, biographical information, entry and statements attributed to you (if true) for advertising and promotional purposes, including without limitation, inclusion in the Whatnot App and Sponsor’s website at https://www.whatnot.com/ and social media channels, without additional compensation.
12. Additional Conditions. Sponsor and Administrator reserve the right, in their sole discretion, to terminate, modify or suspend the Sweepstakes in whole or in part, if in Sponsor or Administrator’s opinion (a) the Sweepstakes is not capable of running as planned by reason of the occurrence of any event beyond its control including, but not limited to, fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications, equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Sweepstakes by any party, or any federal, state, local or provincial government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control, or (b) any other factors beyond Sponsor or Administrator’s reasonable control corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, in all instances without liability to the entrants. Sponsor and Administrator also reserves the right to disqualify any entrant or Winner, as determined by Sponsor and Administrator, in their sole discretion.
13. Governing Law and Choice of Forum. These Official Rules are governed by the law of the State of California, without reference to rules governing choice of laws. Any action, suit or case arising out of, or in connection with, this Sweepstakes or these Official Rules must be brought in the courts located Los Angeles County, California.
14. Personal Information. Sponsor and Administrator may collect personal data about entrants online, in accordance with its privacy policy and as may be more specifically set forth in these Official Rules. Please review these Official Rules and Whatnot’s privacy policy at https://www.whatnot.com/privacy. Entrants agree that Sponsor and Administrator and their respective agents, affiliates, subsidiaries, representatives or service providers may use Entrants’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor and Administrator, such as to notify them of a product or promotion that Sponsor and Administrator think may be of interest.
15. Winners List. For the name of the Winner once it has become available, send your request and a stamped, self-addressed envelope to Command Zone Sweepstakes, Whatnot Inc., 578 Washington Boulevard #1019, Marina del Rey, CA 90292 or send an email message to support@whatnot.com with “Winners List” as the email subject and Command Zone Sweepstakes specified in the body of the email. Requests must be received within four (4) weeks of the end of the Sweepstakes Period.
